Bipartisan legislation to protect retirees from having their lawful retirement reduced after the fact faces critical votes in the Legislature THIS WEEK. SB 266 protects benefits for retirees on fixed incomes – benefits that were promised and paid for – from being taken back because they were miscalculated by the employer or the pension system.

Some background points about SB 266
Some of our retirees are being hit with huge bills and having their fixed incomes reduced, through no fault of their own, long after they’ve retired.
These basic benefits were promised and paid for by the employee and the employer, but are being disallowed after the fact, creating a sizable hardship for retirees on fixed incomes.
In one case, a Davis firefighter received a $42,000 bill and had a fixed income benefit slashed when the employer made a mistake.
Retirees should not be forced to sacrifice a retirement they earned because of mistakes made by CalPERS or their employer.
SB 266 closes this cruel loophole, protecting retirement benefits -- that were promised and paid for – from being taken back after the fact because of mistakes that aren’t the retiree’s fault.
If CalPERS’ pension calculations are wrong, they should be corrected. But they should not be allowed to break their promises to retirees on fixed incomes.
These benefits were promised and paid for. They should not be taken from a retiree who did nothing wrong.
